Terms of Service

These terms govern your use of EnergyIQ hardware and cloud services. Please read them carefully. By using EnergyIQ, you agree to these terms.

1. Acceptance of Terms

By activating an EnergyIQ hub or creating an account, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. These terms are governed by the laws of New South Wales, Australia.

2. The Service

EnergyIQ provides:

  • An EnergyIQ hub device (hardware) sold under separate purchase terms
  • Cloud software that connects to your hub over the internet for remote access, OTA updates, and historical data
  • A mobile application for monitoring and controlling your energy system
  • Price data and solar forecasting services from third-party providers (Amber Electric, Solcast)

3. Energy Trading Disclaimer

Important

EnergyIQ is a control system that executes rules you define. It does not provide financial or investment advice. Any financial outcomes from using EnergyIQ — including electricity bill savings or costs — depend on factors outside our control, including electricity prices, your system's performance, and grid conditions.

You remain responsible for your energy trading decisions and any rules you configure. EnergyIQ provides tools and data; it does not act on your behalf without rules you have explicitly set.

4. Your Account

You are responsible for keeping your account credentials secure. You must be 18 years or older to create an account. One account may be associated with multiple household members, but you are responsible for all activity under your account. Notify us immediately at support@energyiq.com.au if you believe your account has been compromised.

5. Acceptable Use

You agree not to:

  • Attempt to reverse-engineer, decompile, or tamper with hub firmware in ways that circumvent safety protections
  • Use EnergyIQ in ways that violate your electricity retailer's terms or network operator rules
  • Share account access with persons outside your household without using the built-in member invitation feature
  • Attempt to gain unauthorised access to our systems or other users' data
  • Use the service for commercial energy arbitrage at industrial scale beyond residential household use

6. Service Availability

We aim for 99.5% monthly uptime for cloud services but do not guarantee uninterrupted availability. Your hub operates independently of the cloud — core functions (inverter control, rule evaluation, local monitoring) continue during cloud outages. We may perform scheduled maintenance, which we will announce in advance where possible.

7. Software Updates

We may push OTA firmware updates to your hub to fix bugs, add features, or address security vulnerabilities. Security updates are mandatory and may be applied automatically. Feature updates require your consent or are opt-in. You can review our Support Lifecycle Policy for details on how long your device receives updates.

8. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, EnergyIQ's liability for any claim arising from use of the service is limited to the amount you paid for the service in the 12 months preceding the claim, or $100 AUD, whichever is greater. We are not liable for indirect, consequential, or loss-of-profit claims. Nothing in these terms limits statutory guarantees under the Australian Consumer Law.

9. Termination

You may cancel your account at any time from the Settings screen. Upon cancellation, cloud data will be deleted after 30 days (giving you time to export). Your hub will continue to function locally after account deletion.

We may terminate your account if you materially breach these terms and fail to remedy the breach within 14 days of written notice.

10. Changes to Terms

We will notify you of material changes to these terms at least 30 days in advance via email. If you do not accept the updated terms, you may cancel your account before the change takes effect. Continued use after the effective date constitutes acceptance.
